Terms and Conditions

Please read these terms and conditions carefully. In accepting services provided by Precision Lawn Care by Benjamin, you accept the following terms and conditions.

1. Agreement to Terms

If you do not agree to these terms and conditions, please make contact directly to discuss this further. Acceptance of a quote and approval to proceed with work will result in these terms and conditions being automatically agreed to.

The use of the the terms 'us' and 'we' means Precision Lawn Care by Benjamin ABN 59 400 726 535

2. Services

We provide professional lawncare and maintenance services, which may include mowing, edging/trimming, hedge trimming, fertilising, weed control, aeration, seeding, and other related tasks.

3. Estimates and Quotes

We provide estimates and quotes based on the information provided by you regarding your lawncare needs. These estimates are subject to change upon our evaluation of the actual conditions on-site. We will inform you of any changes in pricing or services before proceeding.

4. Payment Terms

Payment is due upon completion of the lawncare service unless otherwise agreed upon. We accept cash and electronic payment. Payment terms are 'on receipt' of invoice. A late payment fee may be issued for delayed payments.

5. Cancellation and Rescheduling

If you need to cancel or reschedule a lawncare appointment, please notify us at least 24 hours in advance. Failure to provide timely notice may result in a cancellation fee equal to the value of the quoted service fee.

We reserve the right to cancel or reschedule services due to inclement weather or other unforeseen circumstances, however any service called by us will not result in a cancelation fee.

6. Property Access

You are responsible for providing us with access to your property on the scheduled service date. If we are unable to access your property, you may be charged a cancellation fee. Please ensure that gates and fences are unlocked and pets are safely contained.

Please ensure your lawn and gardens are free from pet feces/droppings, toys, bones, rocks or any other type of debris before your service day. These types of items are very hazardous if hit by mower blades and can result in serious damage to property and persons.

If we observe debris left on the lawn we will not be able to mow and will still charge your normal service fee.

7. Property Damage (General)

We are professionals and take all due care to ensure that incidents do not occur, but accidents do happen and we carry full public liability insurance for your peace of mind. However, not all damage is automatically covered.

8. Property Damage (Projectiles)

We take all due care to ensure that incidents do not occur, however it is the property occupants responsibility to assist in minimising the risk of such an incident.

We may not be automatically liable for damage from projectiles expelled from our mowers while servicing your property, we always request any items that may become a projectile are removed from your property, by you, prior to our arrival so damage from projectiles cannot occur.

We understand accidents do happen and we will make sure each incident is investigated individually; if an accidental breakage does occur then as stated above we carry full public liability insurance for your peace of mind. Be assured if damage occurs while we are on site, we will notify you immediately and discuss the incident and options for repair.

In rare cases breakages occur that we have not been aware of, if you discover a breakage, after we have serviced your property (e.g. broken car window) please call us immediately. Do not move or clean up anything, as we need to be able to investigate the incident without the area being interfered with. If a vehicle is moved from the location where damaged occurred, before we are given the opportunity to inspect the damage, we cannot be held liable to repair the damage or any costs incurred in repairing the damage.

9. Liability and Insurance

While we take utmost care in performing our lawncare services, we cannot be held liable for damages to property, including but not limited to sprinkler systems, garden lighting, fences, plants, or other structures. It is your responsibility to remove any valuable or fragile items from the lawn and garden area before our arrival. We maintain liability insurance to cover any damages caused by our negligence.

10. Client Responsibilities

You agree to provide accurate information regarding your lawncare needs and to disclose any relevant information about your property, such as underground utilities or sensitive areas. You are responsible for maintaining a safe environment for our personnel and equipment during the provision of services.

11. Complaints and Disputes

If you have any complaints or disputes regarding our services, please contact us promptly to discuss the issue. We will make reasonable efforts to address your concerns in a timely and fair manner.

12. Intellectual Property

All intellectual property rights related to our lawn and maintenance services, including but not limited to trademarks, logos, and content, are owned by us. You may not use, reproduce, or distribute our intellectual property without our prior written consent.

13. Governing Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with the laws of Queensland. Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Queensland.

14. Lawn Renovations

The process of completing lawns renovations involves subjecting the lawn (turf) to a significant level of stress. When requesting this services the property occupant/s must follow the directions of care given by us to ensure best results and recovery. We take all due care to ensure that the actions taken during the lawn renovation process are within industry standards and best practice, however the property occupant/s accepts that lawn death is a possibility and that the property occupant/s must act responsibility to assist in minimising the risk of lawn death by following the directions given.

Due to the limitless factors of consideration before, during and after the lawn renovation process, no guarantees are provided and the property occupant/s unreservedly and irrevocably indemnify us from any claims of costs or compensation as a result of the lawn renovation process.

15. Amendments

We reserve the right to modify or update these terms and conditions at any time without prior notice. By continuing to use our services, you agree to be bound by the revised terms and conditions.
